The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.
It is alleged that petitioner took cash of Rs. 1,58,000/- from the informant for investment in the business, when Rs. 72,000/- was transferred in the account of others. But the petitioner did not return the amount.
It is submitted by the learned counsel for the petitioner that there is no proof with regard to the cash payment to the petitioner, whereas Rs. 72,000/- was transferred in the account of Mr. Saheb Ali and Akhtar Ansari and not in the account of the petitioner. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram in connection with Nokha P.S. Case No. 196 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
