The petitioner is languishing in custody in connection with Azamnagar (Salmari) P.S. Case No. 147 of 2016 for the offences instituted under Sections 25(1-b) a, 26/35 of the Arms Act.
The allegation against the petitioner is that he along with other co-accused looted the Scorpio vehicle of one Mahesh Kumar Yadav by tying his hand and mouth and on being searched, one loaded country made pistol was also recovered from the possession of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.05.2016. The charge sheet has
Patna High Court Cr.Misc. No.29692 of 2016 (3) dt.06-09-2016 2/2 been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. One loaded country made pistol is said to have been recovered. There is no compliance of Section 100 of the Cr.P.C. It is further submitted that the petitioner may be released after completion of 6 (six) months in custody i.e. from 19.05.2016.
On behalf of the State it has been submitted that the petitioner is named in the First Information Report. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of 6 (six) months in custody i.e. from 19.05.2016, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Rai, learned Judicial Magistrate, 1st Class, Katihar, in connection with Azamnagar (Salmari) P.S. Case No. 147 of 2016.
