JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-09-2015 Heard learned counsels for the petitioners and the State. The petitioners being cousin sister-in-laws and mother of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant after 12 years of marriage by administering poison. It is submitted by the learned counsel for the petitioners that the victim was earlier married with Ajay Thakur in 1995 but he died after one year of marriage and thereafter the victim was married with the brother of her late husband namely Bijendra
Patna High Court Cr.Misc. No.36587 of 2015 (2) dt.10-09-2015 2/2 Thakur in 2001 and whereafter the victim was blessed with two children. The husband of the victim Bijendra Thakur has been put on trial where the informant has been examined as P.W. 5 but the informant has not supported the accusation of demand of dowry and most of the witnesses have been declared hostile. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Bhojpur at Ara in connection with Tarari P.S. Case No. 54 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
The learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults without any reasonable cause on three consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
