The petitioner is accused in connection with Siwan Muffasil P.S. Case No. 168 of 2016, registered under Section 171(E) of the Indian Penal Code and Section 47 of Bihar Excise (Amendment) Act, 2016.

The accusation is of recovery of 33 bottles each containing 180 ML and 02 bottle each containing 375 ML I.M.F. liquor and cash of Rs. 22,000/- in front of house of Amit Shah, where the petitioner and two others named in the F.I.R. were found present with intention to distribute the same in the public. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this

Patna High Court Cr.Misc. No.27912 of 2016 (2) dt.14-07-2016 2/2 case. Further submission is that there is no allegation of selling the liquor against the petitioner. The petitioner is in custody since 09.05.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S.
