JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 12-08-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
4233.64 of illicit wine has been recovered from a truck. The allegation against the petitioner is that after seeing the police, he has fled away from the place of occurrence. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is no recovery from the conscious possession of the petitioner and petitioner has got one criminal antecedent of similar nature as stated in
Patna High Court CR. MISC. No.20483 of 2022(2) dt.12-08-2022 2/2 paragraph-3 of the bail application.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioner and submits that the petitioner is the member of the syndicate involved in selling and purchasing of illicit liquor.
Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
