A. ANSARI ORAL ORDER 10-07-2015 This is an application, made under Section 438 of the Code of Criminal Procedure, seeking pre-arrest bail by the petitioners, namely, Arjun Mandal, Kalmi Devi, Pramod Mandal @ Sajjan Bihari and Pawan Mandal, in connection with Pipra P.S. Case No. 245 of 2013 under Sections 363/366A of the Indian Penal Code.

Heard Ms. Veena Kumari Jaiswal, learned counsel for the petitioners, and Ms. Veena Rani Prasad, learned Additional Public Prosecutor, appearing on behalf of the State. Upon investigation, since the police have already submitted a report in terms of Section 173(2)(i) Cr.PC. stating to

No.43739 of 2014 (4) dt.10-07-2015 2/2 the effect that the accusations against the petitioners are not well founded, the petitioners do not, at this stage, press this application for pre-arrest bail, but seek liberty to apply for anticipatory bail, in future, if the situation so warrants.

To the submissions so made, no objection has been raised on behalf of the opposite party.

In view of the above and in the interest of justice, this application is hereby disposed of as not pressed with liberty to the petitioners to approach this Court with appropriate application, in future, if so advised.
