2. The petitioner seeks bail in connection with Belaganj P.S. Case No. 168 of 2021 instituted for the offences punishable under Sections 147, 149, 341, 323, 504 and 302 of the Indian Penal Code.
3. As per the prosecution case, the accused petitioner along with other co-accused persons armed with lathi, danda, bricks and stones assaulted the informant and his family members due to land dispute attributed between the parties.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to dirty village politics. He submits that there is land dispute attributed between the
Patna High Court CR. MISC. No.19154 of 2025(2) dt.16-04-2025 2/3 parties. He further submits that there is no specific allegation against the petitioner rather the allegations are general and omnibus in nature. Petitioner has got clean antecedent as stated in para 3 of the petition is in custody since 22.01.2025.
5. Learned APP opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-XVII, Gaya dated 11.02.2025, it appears that petitioner is named in the FIR. From perusal of the records, it also appears that on the basis of written report of the informant Ashok Kumar, FIR has been lodged against twenty four co-accused persons including the present petitioner under Sections 147, 149, 341, 323, 504 and 302 of the Indian Penal Code. There is no specific allegation of assault against the petitioner. Similarly situated co-accused persons namely Janeshwar Prasad, Ravi Kumar, Umesh Yadav, Kamindra Yadav, Bhuvneshwar Yadav @ Bhuneshwar Yadav, Amarjeet Kumar, Siya Saran Yadav, Binod Yadav, Sudhir Yadav, Kapil Yadav and Kishori Yadav have been granted regular bail by a Co-ordinate Benches of this Court in Cr. Misc. Nos. 51878 of 2021, 61563 of 2021, 10326 of 2023,669 of 2023 and 7221 of 2023 vide orders dated 30.03.2022, 16.03.2023, 29.03.2023 and 03.05.2023, respectively, accordingly the prayer for bail of the
Patna High Court CR. MISC. No.19154 of 2025(2) dt.16-04-2025 3/3 petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM-II, Gaya in connection with Belaganj P.S. Case No. 168 of 2021.
