The petitioners seek bail in Saraiya P.S. Case No. 571 of 2018, instituted for the offence under Section(s) 366 and 366(A)/34 of Indian Penal Code.

Counsel for the petitioners submits that victim girl on recovery has given statement under Section 164 Cr. P.C. wherein she has not levelled any allegation of specific overt act against the petitioner. She has levelled allegation against Mitranjan Paswan of committing illegal act with her. Counsel for the petitioners further submits that co-accused Dharmendra Paswan has already been granted bail by coordinate Bench of

Patna High Court CR. MISC. No.27273 of 2019(4) dt.12-07-2019 2/2 this Court vide order dated 1.5.2019 passed in Cr. Misc. 19851 of 2019.

In this manner, mere suspicion has been raised against the petitioner in the written report. Petitioner is in custody since 6.12.2018 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Muzaffarpur, in connection with Saraiya P.S. Case No. 571 of 2018, subject to the condition that both the bailors will be close relatives of the petitioner.
