The petitioner seeks bail in a case instituted for the offences under Sections 420 and 406 of the Indian Penal Code. The prosecution case in short is that Rs. 7,88,285/- was missing from the locker of the Bank.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.1.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. The petitioner has falsely been implicated in the present case. There is no substantive evidence

Patna High Court CR. MISC. No.19335 of 2019(3) dt.14-05-2019 2/2 to suggest his implication in the present case. On behalf of the State and the O.P. No. 2, it is submitted that the petitioner is named in the F.I.R. The petitioner is the custodian of the key of the locker of the Bank. Rs. 7,88,285/- is said to have been missing from the Bank. Considering the nature of accusation, I am not inclined to grant bail to the petitioner in connection with Kankarbagh P.S. Case No. 62 of 2019. The same is rejected. The Trial Court is directed to conclude the trial preferably within a period of nine months from the date of receipt/production of a copy of this order.
