JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-09-2020 The office has reported that the defect nos. 6(1) and 6 (4) still standas defect no. 6(4) has only partly been removed. Learned counsel of the petitioner submits that he has filed xerox-copy of the impugned order through email for removal of the defect no. 6(4) and so far as the defect no. 6(1) is concerned, the aforesaid defect cannot be removed by the petitioner because the same is default of the police officials. However, learned counsel of the petitioner submits that petitioner would file certified copy of the impugned order within four weeks from the date when the court starts normal functioning.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State.
Patna High Court CR. MISC. No.20564 of 2020(3) dt.21-09-2020 2/2 Petitioner seeks bail in a case registered for the offences punishable under Sections 379 of the Indian Penal Code.
Petitioner is not named in the first information report and it appears that the name of petitioner surfaced in this case in course of investigation on the basis of confessional statement. Petitioner is in jail custody since 19.06.2019. Learned Additional Public Prosecutor for the State points out that petitioner does have criminal antecedent of several cases which is evident from perusal of Annexure-3 to the petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, East Champaran at Motihari in connection with Harsidhi P.S. Case No. 123 of 2019.
