1. Heard learned counsel for the parties.

2. The petitioners have preferred this application for grant of regular bail in connection with Thali P.S. Case no.248 of 2025 registered under sections 87 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that his 17 year old minor granddaughter was kidnapped by the petitioners herein for the purpose of marriage.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. It is a case of love affair between the brother of petitioner no.2 and the granddaughter of the informant. The granddaughter of the informant was recovered and her statement was recorded under

Patna High Court CR. MISC. No.20899 of 2026(4) dt.15-07-2026 2/3 section 183 of the B.N.S.S. wherein she has not supported the prosecution case. The petitioners who are in custody since 26.12.2025 were enlarged on provisional bail during pendency of the instant application.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Also heard learned counsel for the informant who does not oppose the application for bail of the petitioners.

In course of investigation, the statement of the victim was recorded under section 183 of the B.N.S.S. wherein she has stated about her love affair with Rahul Kumar (son of petitioner no.1 and brother of petitioner no.2), of having gone out with him and having married him out of her own volition. She has not supported the prosecution case.

8. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR and the contents of the statement of the granddaughter of the informant recorded under section 183 of the B.N.S.S., the Court is inclined to enlarge both the petitioners on bail.

9. Hence, the provisional bail granted to the petitioners in connection with Thali P.S. Case no.248 of 2025 on furnishing bail bonds of Rs.10,000/ (Rupees Ten Thousand)

Patna High Court CR. MISC. No.20899 of 2026(4) dt.15-07-2026 3/3 each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Nawada/concerned Court by order dated 2.4.2026 passed in the instant application is hereby confirmed.
