JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-08-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecution for the State.

The petitioner seeks bail in a case instituted for the offences punishable under Sections 399, 402, 413 and 414/34 of the Indian Penal Code and Section 25(1-B)a/26/35 of the Arms Act.

One iron rod and mobiles are said to have been recovered from the conscious possession of the petitioner when he and some others were caught by the police. The police claim that petitioner and his associates were making preparation for committing dacoity, but submission on behalf of the petitioner is that the petitioner has been implicated in this case on mere suspicion and moreover, petitioner does not have any criminal antecedent and is languishing in jail since long.

Case No. 202 of 2016.
