JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioners and learned counsel for the State.

Petitioners apprehend arrest in connection with Kudhani P.S. Case No. 19 of 2016 registered under Sections341, 323, 325, 354, 380, 427 of the Indian Penal Code. It is alleged that the accused persons entered into the house after breaking the wall and tried to outrage her modesty, but when she started abusing she was assaulted. The accused persons committed theft of ornaments and rice. When they assaulted, she became naked.

Learned counsel for the petitioners submits that petitioners have not committed any such offence. Petitioners have clean antecedent.

Patna High Court Cr.Misc. No.3431 of 2017 (3) dt.14-02-2017 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that petitioners are named accused and there is specific allegation against them. Considering the nature of allegations levelled against the petitioners and the submissions advanced on behalf of the State, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. Their prayer for anticipatory bail is, therefore, rejected.
