2. The accused/petitioner is named in the F.I.R. and apprehended his arrest in connection with Yadunathpur P.S. Case No. 01 of 2024 registered for the offences punishable under Section 115(2), 126(2), 352, 303(2), 76 and 3(5) of the BNS.

3. The allegation against the petitioner is to assault and disrobe the modesty of informant along with other named co-accused persons/family members, where allegation is also available to take away Rs. 400/- from informant during

4. Learned counsel appearing on behalf of the petitioner submitted that from the face of FIR it can be gathered easily that present occurrence took place for the non-payment of Rs. 500/- against purchase of vegetables. It is submitted that allegation appears unbelievable, as to disrobe a women in presence of son, daughter-in-law and other family members with sexual intent. While concluding the argument learned counsel submitted that petitioner is a man of clean antecedent and moreover, other named coaccused persons were granted bail by learned Trial Court itself.

5. Learned APP appearing on behalf of the State, opposes the prayer for anticipatory bail.

6. In view of aforesaid facts and circumstances and by taking note of the nature of accusations, where allegation to disrobe prima-facie not appears with sexual intent, accordingly the petitioner above named, in the event of his arrest or surrender before the learned Trial Court within a period of four weeks, is directed to be released on bail,

No.22653 of 2025(2) dt.30-04-2025 3/3 furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dehri Rohtas/concerned Trial Court where the case is pending in connection with Yadunathpur P.S. Case No. 01 of 2024 subject to the conditions as laid down under Section 438(2) of the Cr.P.C./ Section 482(2) of the BNSS.
