There is no reason why the statutory interest on gratuity would not be paid to these petitioners. If the BIADA is interested that there has to be a judicial order in each and every

Patna High Court CWJC No.11535 of 2015(3) dt.21-09-2017 2/2 case, even though an adjudication is not required to be made on the factual and legal aspect, the only thing, which is required to be done, is to impose a cost of Rs. 25,000/- on BIADA, which will be payable to the petitioners, if in case the statutory interest is not paid to the petitioners by 30th of September, 2017. Writ Application stands disposed off with observation / direction as above.
