2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 306 of the Indian Penal Code.
3. According to F.I.R., informant suspects that due to mental torture given by the accused persons including this petitioner, son of the informant committed suicide.
4. It is submitted on behalf of the petitioner that from bare perusal of the F.I.R. it is apparent that no direct or active role has been attributed to this petitioner which led the deceased to commit suicide. He next submitted that co-accused Rajni Kant @ Rajnee Kant, who is owner of the bakery shop,
Patna High Court CR. MISC. No.26284 of 2024(2) dt.19-04-2024 2/2 has already been granted anticipatory bail by this Hon'ble Court vide order dated 17.02.2024 passed in Cr. Misc. No. 5335 of 2024. Petitioner has got clean antecedent.
5. Learned counsel for the informant vehemently opposed the bail application.
6. Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Samastipur Town P. S. Case No. 184 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
