The petitioner is languishing in custody since 31.10.2018 in a case registered for the offences punishable under Sections 399, 400 and 402 of the IPC and Sections 25(1-B)a, 26 and 35 of the Arms Act.

The prosecution case is that on information that certain miscreants are preparing to commit dacoity, raid was laid and three accused persons including the petitioner were apprehended, when from the possession of the petitioner, one country made loaded pistol was recovered.

It is submitted by learned counsel for the petitioner that the petitioner has maliciously been roped in the present case. A statement has been made in paragraph no.3 of the petition that

Considering the nature of recovery, investigation being already concluded and period under custody, coupled with the statement made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned SDJM (East) Muzaffarpur in connection with Mithanpura P.S.
