The petitioner apprehends his arrest in connection with Rahui P.S. Case No. 26 of 2020 registered for the offences under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

Recovery of commercial quantity of liquor was made from the house of the petitioner and the petitioner was not apprehended on the spot and he was seen running away from the place of occurrence.

In view of the law laid down by the Full Bench of this Couert in the case of Ram Vinay Yadav Vs. The State of Bihar reported in [2019 (2) PLJR 1089 (Full Bench)], this anticipatory bail application is not maintainable. Hence, it is dismissed as not maintainable.
