Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 302 and other allied sections of the Indian Penal Code and 27 of the Arms Act.

According to the prosecution case itself, it was co- accused Manish Kumar @ Gore Singh who shot fire on the deceased causing injury to him. Post mortem report reveals that only one firearm injury was found on the person of the deceased.

No doubt, petitioner is named in the first information report but general allegation of making firing has been levelled allegation the petitioner.

Patna High Court Cr.Misc. No.31135 of 2016 (2) dt.12-08-2016 Learned counsel for the petitioner submits that one coaccused Pintu Singh having similar allegation has already been granted privilege of anticipatory bail by a coordinate bench of this court.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate III, Nawada in Narhat (Sitamarhi) P.S. Case no. 60/2016. shahid (Hemant Kumar Srivastava,J) U T
