Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Mr. Shailendra Kumar Singh, learned counsel for the B.S.F.C., has filed a counter affidavit is taken on record. The petitioners seek anticipatory bail in connection with Inarwa P.S. Case No. 49 of 2018, registered for the offence under Sections 406, 420, 409 of the Indian Penal Code. Learned counsel for the petitioners submit that he has deposited entire disputed amount in the bank.

Patna High Court CR. MISC. No.30692 of 2021(5) dt.13-04-2022 2/2 Considering the submission of the parties and in view of the above statement of the petitioners this application for anticipatory bail is allowed.

Let the petitioners, above named, in the event of their arrest/surrender within four weeks from today in the court below, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judicial Magistrate, 1st class Saran at Chapra, in connection with Inarwa P.S. Case No. 49 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. At the time of acceptance of bail bond the Court below will verify the no dues certificate from the officials of the bank has been issued. Initially the Court below will grant provisional bail to the petitioners and after verification of the no dues certificate from the bank officials, the provisional bail shall be confirmed. In case the submission of deposit is found false the petitioners shall be taken into custody.
