Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was twice rejected by this court but submission on behalf of the petitioner is that having more or less similar allegation, almost all the accused have already been granted privilege of bail by different Benches of this Court and so far as petitioner is concerned, he is in jail custody since 22.08.2014 but up till now, his trial could not be concluded.

No.40520 of 2016 (2) dt.03-10-2016 2/2 Learned counsel appearing for the informant submits that out of seven charge sheeted witnesses, four prosecution witnesses have already been examined and so far as delay in conclusion of trial is concerned, the same was caused due to non cooperation of petitioner and other accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of allegation levelled against the petitioner as well as stage of the trial, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 230 of 2013.
