JUSTICE SUDHIR SINGH ORAL ORDER 26-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 147, 148, 149, 341, 323, 324, 307 and 302 of the Indian Penal Code.

Allegation against the petitioners is that due to some dispute petitioners along with others assaulted informant, his brother and father. His brother died in course of treatment and father was brought to Banaras for better treatment. It has been submitted on behalf of the petitioners that they are in custody since 12.11.2015. Chargesheet has been submitted against petitioners. Altogether seven persons are named in F.I.R. General and omnibus allegation has been made against petitioners. No injury has been attributed against petitioners. Other co-accused persons have been granted bail vide Annexure-3 and Cr. Misc. no. 32193 of 2016.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail

Patna High Court Cr.Misc. No.33518 of 2016 (3) dt.26-09-2016 2/2 bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge-IV, Sasaram, District-Rohtas, in connection with S. Tr. No. 64 of 2016 arising out of Dawath P.S. Case no. 107 of 2015.
