JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 20-05-2022 On 11.04.2022, the anticipatory bail petition of this petitioner was rejected and the Senior Superintendent of Police, Patna was directed to furnish a report as to why the petitioner has not been arrested up-till now, when his anticipatory bail was rejected five years back by this Court, vide order dated 22.09.2017 in Cr. Misc. No. 34118 of 2017. The Senior Superintendent of Police, Patna was directed to send the report within a period of two months from 11.04.2022. The learned counsel for the petitioner has submitted that the petitioner has surrendered before the court below, but the court below assuming the present petition to be pending is not proceeding to hear the regular bail petition. If it is true, the learned court below shall take up the
Patna High Court CR. MISC. No.29578 of 2021(6) dt.20-05-2022 2/2 regular bail petition of the petitioner and pass a final order on it. The anticipatory bail petition is not pending before this Court, rather the prayer for anticipatory bail was rejected by this Court, vide order dated 11.04.2022 only the report of Senior Superintendent of Police, Patna is awaited. This may not be taken as impediment in hearing of the regular bail petition of the petitioner on merit, but the learned court below shall hear the other regular bail petitions filed prior to this one on more priority basis.
As the petitioner has surrendered before the court below, this case need not be listed.
