JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-10-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioners happen to be parents in law of the deceased, whose marriage had taken place ten years ago and after marriage she had given birth to two children out of her wedlock. Moreover, in course of investigation, some witnesses stated that petitioners were separate from the husband of the deceased. Learned counsel for the petitioners submits that post mortem report of the deceased goes to show that doctor did not
Patna High Court Cr.Misc. No.33898 of 2016 (3) dt.22-10-2016 2/2 find any injury on the person of the deceased. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jhanjharpur in connection with Madhepur P.S. Case No. 07 of 2016.
