JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner as well as learned Additional P.P. for the State.

Petitioner happens to be elder brother-in-law of the deceased and is languishing in jail custody since 26.03.2016 in a case registered for the offences punishable under Sections 304(B), 201, 341, 323, 504 and 34 of the IPC. Learned counsel for the petitioner referred paragraphs-29 and 43 of the case diary and submits that the deceased committed suicide on account of petty family dispute and as a matter of fact on the alleged date of occurrence, the mother of the deceased had come to matrimonial home of the deceased and she had pacified the deceased, as the deceased was adamant to go to her maternal place and the deceased was not

Patna High Court Cr.Misc. No.33603 of 2016 (3) dt.17-10-2016 2/2 ready to listen even the advice of her mother and subsequently, she committed suicide which is evident from perusal of the aforesaid paragraphs. The investigation against the petitioner has already been completed.

Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM, Gopalganj in connection with Barauli P.S.Case No.64 of 2016.
