The petitioner seeks bail in connection with Dhoriya P.S. Case No. 165 of 2022 registered for the offence under Section 366(A) of the Indian Penal Code.

The prosecution case is based on the basis of Fardbeyan of the informant alleging inter-alia therein that informant is the resident of District Banka and the daughter of the informant has been continuously in touch with a person for the last six months. The person with whom she had been in touch is one Nard Sharma and his friend Sumit Kumar and both of them are the resident of Bhagalpur District. It is further alleged that both the boys came on a motorcycle and tried to kidnap the minor daughter of the informant with an intention to marry her.

No.24046 of 2023(2) dt.18-05-2023 2/2 Learned counsel for the petitioner submits that he is falsely been implicated in this case due to dirty politics of the village and has not committed any offence and in the statement of the victim girl recorded under Section 164 Cr.P.C. she states that she is in love with the petitioner for long and she has solemnized marriage with the petitioner.

Learned counsel for the petitioner also submits that the petitioner is in custody since 15.05.2022. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the aforesaid facts and the period of custody, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Additional Sessions Judge-VI-cum-Special Judge, POCSO, Banka in connection with Dhoriya P.S. Case No. 165 of 2022.
