Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 47, 49, 51 and 54 of the Bihar Excise Act, 2016. In huge quantity of spirit and country made liquor were recovered from the field of Ajay Pratap Singh. The villagers disclosed that petitioner and other F.I.R. named accused were selling the aforesaid seized liquor. Admittedly, neither the petitioner was arrested on the spot nor anything was recovered from his conscious possession. Moreover, having more or less similar allegation, co-accused Surendra Mahto has already been granted

Patna High Court Cr.Misc. No.30734 of 2016 (2) dt.08-08-2016 2/2 privilege of bail by a co-ordinate Bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amender Prasad, Judicial Magistrate, Saran at Chapra in connection with Amnour P.S.
