The present application seeking modification of the order dated 17.10.2016 passed in Cr. Misc. No. 44066 of 2016 by which this Court has granted anticipatory bail to the petitioners in Gaya Rail (GRPS Gaya) P.S. Case No. 192 of 2016 in which it was stipulated that they shall be released in the event of arrest or surrender before the Court below within six weeks from that day. Learned counsel for the petitioners submitted that they were accused in another case also and by the time anticipatory bail was granted in the other case, the time in the present case had expired.
Patna High Court Cr.Misc. No.2072 of 2017 (2) dt.08-03-2017 2/2 Learned A.P.P. does not oppose.
In view of the aforesaid, the time fixed for the petitioners to surrender before the Court below in order dated 17.10.2016 in Cr. Misc. No. 44066 of 2016 stands extended till 31st March, 2017.
Accordingly, the order dated 17.10.2016 in Cr. Misc. No. 44066 of 2016 stands modified to the extent indicated above. The rest of the order shall remain the same. The application stands disposed off in the aforementioned terms.
