Petitioner seeks bail in K. Nagar P.S. Case No.233 of 2018 instituted for the offence under Section(s) 364/34 Indian Penal Code.

Counsel for the petitioner submits that in the written report it is mentioned that petitioner is known to the informant. The informant has returned on very next day and his statement under Section 161 Cr.P.C. was recorded. The police did not get his statement recorded under Section 164 Cr.P.C. Petitioner has been implicated merely because of money dispute. In the written report, it is alleged that on date of occurrence while the son-in-law of informant was coming to the

Patna High Court Cr.Misc. No.58751 of 2018 (2) dt.04-10-2018 2/2 house, 3-4 unknown accused persons came on a Bolero vehicle and kidnapped the son-in-law of the informant. Allegation against this petitioner is that he stopped the Bullet motorcycle of the son-in-law of the informant.

Petitioner is said to be in custody since 29.06.2018. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Nagar P.S. Case No.233 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
