JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 414 of the Indian Penal Code.

Allegation against the petitioner is that he was apprehended by police while he was trying to escape after getting down from a passenger train and from his pocket one golden earring and a Samsung mobile were recovered. It has been submitted on behalf of the petitioner that he is in custody since 1.6.2016. Chargesheet has been submitted against the petitioner. He has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner had no knowledge that the earring in question was a stolen property. The said earring in question is claimed by the petitioner of his own mother. No case has been instituted in respect to theft of the earring in question. He has been made accused due to mistake of fact.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the
