The petitioner, who is in custody, seeks bail in connection with Alauli P.S. Case No. 139 of 2018 registered for the offence punishable under Sections 457 and 380 of the Indian Penal Code.

Allegation against petitioner and other co-accused are of committing theft in the house of informant. It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated in this case. No recovery has been made from the possession of the petitioner. It has been further submitted that two petitioners have fled away by taking box and ornaments but this petitioner could not flee away and was apprehended. Nothing was recovered

Patna High Court Cr.Misc. No.59142 of 2018(2) dt.09-10-2018 2/2 from possession of petitioner. Petitioner has no criminal antecedent and he is in custody since 08.05.2018. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Alauli P.S. Case No. 139 of 2018.
