The petitioner apprehends his arrest in a case registered under Sections 341, 342, 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code.

Accusation is that the petitioner and six others cut the ridge of the field of the informant and when the informant and his family members protested, the informant was assaulted by Mahboob Alam with farsa causing injury on his head. This petitioner caused injury through sickle causing injury at the head of Barik.

Learned counsel appearing on behalf of the

Patna High Court Cr.Misc. No.2039 of 2017 (2) dt.25-01-2017 2/2 petitioner submits that, in fact, due to land dispute Marpeet took place in which the petitioner and others also sustained injuries regarding which Manshi P.S.Case No. 70 of 2016 was instituted on the written report of the brother of the informant. Moreover, the allegation has been made against the petitioner to cause injury at the head of Barik through sickle but two injuries have been found on the person of Barik, which are said to have been caused by hard and blunt substance.

In the facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender in the court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Katihar, in Manshi P.S.Case No. 72 of 2016, subject to the conditions as laid down u/s 438(2) Cr.P.C.
