This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 406/420 and 120(B) of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the parties are related to each other and the father of this petitioner had instituted a criminal case, bearing Phulparas P.S. Case No. 100 of 2012, against the brother of the informant. He submits that institution of the present Jhanjharpur P.S. Case No. 88 of 2012 is a counter blast of the earlier case filed by the father of the petitioner. Under the facts and circumstances, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within eight weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jhanjharpur, Madhubani, in connection with Jhanjharpur P.S. Case No. 88 of 2012 (G.R. No. 943 of 2012), subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
