The petitioner apprehends her arrest in connection with Kunouli P.S.Case No. 71/2014 for offences alleged under Section 306/34 of the I.P.C.
The prosecution case is that the informant Dukhani Devi, mother of the deceased Sunita Devi, alleged before the S.H.O. Kunouli P.S. alleged that on 30.11.2014 at 8.30 A.M. her son-in-law, Ramanand Kamat @ Chhotu informed her through mobile phone and called her at his house. When she reached there she saw that a large crowd had assembled at his house and smoke was emanating from the room of her daughter. The local people disclosed that on previous night some altercation took place between her daughter and son-in-law and due to the said annoyance/anger her daughter along with three children closed
Patna High Court Cr.Misc. No.36813 of 2015 (2) dt.09-09-2015 2/2 herself in a room and sprinkled kerosene oil on herself and ignited fire herself. As a result her daughter and her " Nati", Kunal Kumar died in the room and two injured " Natini" were taken into hospital in injured condition. She also alleged that her son-in-law and his family members used to torture her daughter on account of which she ignited fire that caused her death as well as her children. It has been submitted by the learned counsel for the petitioner that the petitioner is mother-in-law of the deceased Sunita Devi and the deceased had committed suicide. It has further been submitted that the petitioner lives separately and allegation of altercation is between husband and wife.
Be that as it may, let the petitioner, above named, namely, Urmila Devi in the event of arrest/surrender, will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Birpur (Supaul) in connection with Kunouli P. S. Case No. 71/2014, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
