The petitioner apprehends his arrest in connection with Kurhani P.S. Case No. 17 of 2013 registered under Sections 147, 148, 149, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegedly, petitioner and others surrounded the informant and the petitioner directed to withdraw the cases filed against Mukhiya and caused threats and on the next day when the informant was trying for Panchayati then on the instigation of Chandan Kumar @ Bhaskar, the petitioner shot Surendra Sahni in his stomach, who was brought to Maa Janki Hospital where treatment was going on.
Submission is for false implication and that it is a
Patna High Court Cr.Misc. No.42347 of 2014 (2) dt.04-03-2015 counter-blast of Kurhani P.S. Case No. 18 of 2013 and other coaccused have been allowed pre-arrest bail in Criminal Misc. No. 49994 of 2013 vide order dated 11.03.2014 and, as such, the petitioner also deserves sympathetic consideration to which the learned A.P.P. opposes.
Considering that against the petitioner there is allegation of causing firearm injuries in the stomach of Surendra Sahni and, as such, this Court is not persuaded to grant the prearrest bail to the petitioner and accordingly, such prayer stands rejected.
