KUMAR ORAL ORDER (The proceedings of the Court are being conducted through Video Conferencing and the Advocates joined the proceedings through Video Conferencing from their residence.) 31-08-2021 Heard learned counsel for petitioners and learned counsel for the State.

Petitioners, who are in custody, seek bail in a case registered for the offences punishable under Sections 341, 323, 354, 307, 379 and 504 of the Indian Penal Code. Informant has alleged that on 07.01.2021 at about 4:00 P.M., while his daughter was returning home from her 'Gottha', Dhanpat Ram (Petitioner No. 2) started teasing her. On 08.01.2021 when he and his family members objected, F.I.R. named accused including petitioners started abusing and assaulting him and his family members with lathi and iron rod, as a result of which they sustained head injuries and Angad Ram

Patna High Court CR. MISC. No.30779 of 2021(2) dt.31-08-2021 2/3 (Petitioner No.1) snatched Rs. 4,000/- from his pocket. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case due to dirty village politics. Petitioners and informant are the next door neighbours and the occurrence took place between them due to land dispute. There is general and omnibus allegation against petitioners. Injury found is stated to be simple in nature. Petitioners have no criminal antecedents and are in custody since 09.01.2021.

Considering the aforesaid facts and circumstances of the case, let petitioners named above be released on bail upon furnishing bail bonds of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Bagaha, West Champaran, in connection with Ramnagar P.S. Case No. 11 of 2021, subject to conditions that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioners shall cooperate in the trial and shall be properly

(3) If petitioners tamper with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
