Petitioner apprehends his arrest in Madanpur P.S. Case No.283 of 2018, registered under Section 498A and other sections of the Indian Penal Code.

The wife of the petitioner filed Complaint Case No.531 of 2018 on the basis of which the present FIR was registered. The informant alleged in her complaint petition that she was married in the year 2007. Her husband took her to Indore but her husband had illicit relation with one Lalita Devi. When the informant protested, her husband and Lalita Devi assaulted her. The informant narrated her entire story how her husband and other family members subjected her till the year 2018.

Patna High Court CR. MISC. No.20621 of 2019(2) dt.03-04-2019 2/2 Learned counsel for the petitioner submits that entire allegation is false and concocted. The informant was not ready to live with the petitioner and ultimately the petitioner filed Matrimonial Case No.108 of 2018 under Section 13 of the Hindu Marriage Act seeking divorce. Thereafter the wife of the petitioner filed complaint case on 09.07.2018. Taking into consideration the facts that the marriage was solemnized in the year 2007 and the present case is filed only after the husband filed divorce case against the informant, let petitioners, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Madanpur P.S. Case No.283 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
