The petitioner seeks bail in anticipation of his arrest in connection with Patepur P.S. Case No. 267 of 2019 instituted for the offences under Sections 147, 148, 149, 452, 380, 436, 353, 332, 333,
307, 153, 504, 379, 511, 186, 188, 427 and 506 of the Indian Penal Code and Section 27 of the Arms Act.
As a protest against the killing of one Nutan Kumari, the road was blockaded. When the police party arrived, the members of the mob, who had collected at the spot, indulged in arson. It has been submitted on behalf of the petitioner that though he has been named in the F.I.R., but has not been attributed with any specific accusation. The petitioner runs a poultry farm and while he was returning from Patepur market, he found that a big crowd had assembled at a place. He was just a by stander and has falsely been made accused in this case.
Regard being had to the nature of accusation against the petitioner, he, in the event of his arrest/surrender before the Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-IX, Vaishali at Hajipur in connection Patepur P.S. Case No. 267 of 2019,
subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
