ANJANA MISHRA ORAL ORDER 05-08-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341/323/307/504/506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that there is a history of litigation between the parties and a Partition Suit bearing Partition Suit No. 38 of 1981 is pending before the Court of learned Sub-Judge, Aurangabad. It is further submitted that the petitioners and informant's side are agnates and injuries purported to have been inflicted on the informant's side have all been found to be simple in nature.

No.30363 of 2016 (2) dt.05-08-2016 P2/2 Considering the aforementioned facts and circumstances and petitioner No. 2 (Manoj Kumar @ Manoj Yadav) having clean antecedent and petitioner Nos. 1, 3 and 4 are having one case each, which have been filed by the same parties, let the petitioners above named, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Nabi Nagar P.S. Case No. 49 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
