JUSTICE ASHUTOSH KUMAR ORAL ORDER 02/- 17/07/2020 Heard Mr. Sunil Kumar, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 709 of 2019 instituted for the offences under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

It appears from the First Information Report that the petitioner was not arrested from the spot; rather his implication in this case is on the basis of confessions made by Manish Kumar and Rahul Kumar, who were arrested on the spot. At the time of the occurrence, the petitioner is stated to be in Gujarat.

The petitioner claims to be a person of clean antecedent. Considering the facts afore-stated, the petitioner above-named, in the event of his arrest/surrender before the Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bond in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection Mahua P.S. Case No. 709 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
