The Petitioner apprehends his arrest in Sakatpur P.S. Case No.52 of 2016 instituted for the offence under Section(s) 363, 366-A/34 Indian Penal Code.

It has been submitted on behalf of the petitioner that the victim girl in her statement recorded under Section 161 Cr. P.C. before the police has stated that she was in love with Md. Akbar since he was working in the poultry farm of this petitioner. The victim was recovered with Md. Akbar and her statement under Section 164 Cr. P.C. was recorded, wherein, she has taken the name of the petitioner alleging that Md. Akbar was supported by this petitioner.

Patna High Court Cr.Misc. No.1794 of 2017 (3) dt.14-02-2017 2/2 In the written report, the informant has alleged that his minor daughter has been kidnapped by Md. Akbar along with his parents, brother and this petitioner.

In such circumstances, there is no allegation of any specific overt act against this petitioner.

In the facts and circumstances of the case, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Sakatpur P.S. Case No.52 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Darbhanga, subject to the conditions as laid down under Section 438(2) Cr. P. C.
