JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the daughter of the informant is languishing in custody since 18.1.2016 in a case registered for the offences punishable under Sections 498A and 304B/34of the Indian Penal Code and sections 3 and 4 of Dowry Prohibition Act.

The prosecution case is that the informant Jagdish Yadav married his daughter Pinki Kumari with the petitioner on 4.4.2008. Subsequent to the marriage, there was torture for nonfulfillment of further dowry demands. On 12.2.2015 the informant received information that his daughter has been killed by strangulating.

It is submitted by the learned counsel for the petitioner

Patna High Court Cr.Misc. No.28518 of 2016 (2) dt.10-08-2016 2/2 that as per own admission of the informant the victim died after about seven years of marriage and on conclusion of investigation final report has been submitted under section 306 IPC and consequently, cognizance has also been taken under section 306 IPC vide order dated 18.3.2016 passed by the learned ACJM, Danapur. Certified copy of the order has been produced. Let it be kept on record.

Considering the fact that the investigation has already concluded and final report has been submitted under section 306 IPC and consequently cognizance has also been taken under section 306 IPC, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Danapur in connection with Bihta P.S. Case No. 102 of 2015.
