Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 323, 341, 504, 506, 354, 307 of the Indian Penal Code. The prosecution case is that the informant was getting his boundary wall erected which was objected by the accused persons. On protest being made the accused persons assaulted the informant with fists and slaps and this petitioner tried to strangulate the informant and when wife Sulochana Devi and daughters-in-law of the informant Ranju Devi and Nutan Devi came to rescue then this petitioner stripped Nutan Devi. This petitioner took away cash of Rs. 20,000/- of the informant. The accused persons also snatched jewellary of the informant's side.
It is submitted by learned counsel for the
Patna High Court Cr.Misc. No.37261 of 2015 (2) dt.14-09-2015 2/2 petitioner that accusation has been levelled in the background of land dispute and daughter-in-law of the informant Nutan Devi in her statement during investigation has not supported the accusation of being stripped by this petitioner. It is submitted by learned counsel for the informant that accusation is specific against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Shankarpur P.S. Case No. 60 of 2014, pending in the Court of learned Judicial Magistrate, Madhepura.
With the observations above, the application stands disposed off.
