The petitioner seeks bail in a case registered for offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 1350 litres foreign liquor were recovered from a Pick Up Van which was being boarded by two persons including the petitioner. Petitioner is claimed to be driver of the aforesaid Van. It is urged that the petitioner has falsely been implicated in this case merely on suspicion as he had no knowledge about the seized illegal liquor. Petitioner claims that he is having clean antecedent and is in custody since 09.07.2018.

No.59342 of 2018(2) dt.06-10-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ADJ II-Cum- Special Judge, Gopalganj in connection with Excise Case No. 153 of 2018. Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
