JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner and three others are named in the first information report. The informant claims that at the time of alleged occurrence she saw the petitioner and other F.I.R. named accused running towards their home and after that she found the dead body of her son hanging with a tree. The informant admitted in her ferdbeyan that there was partition dispute between her and F.I.R. named accused.

The investigation against the petitioner has already

Patna High Court Cr.Misc. No.28631 of 2016 (2) dt.19-07-2016 2/2 been completed and it appears from perusal of the impugned order that not a single prosecution witness claims to have seen the actual killing of the deceased.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjit Prasad, Judicial Magistrate 1st Class, Danapur, Patna in connection with Sigori P.S.
