JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Sonbarsa Raj P.S. Case No. 77 of 2016/ G.R. No. 1443 of 2016 for the offences punishable under sections 363, 366 and 34 of the I.P.C. Allegedly, the wife and eight years old son of the informant became traceless and on enquiry the photograph of the petitioner was found in the house and then it was learnt that the petitioner and others have kidnapped the wife of the informant with an intention to marry with her.
Submission is of false implication and that only on suspicion the petitioner has been named, there is no legal and
Patna High Court Cr.Misc. No.3961 of 2017 (3) dt.15-03-2017 2/2 tangible material against him and as such the petitioner deserves sympathetic consideration.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner by submitting that during investigation the petitioner has been found absconding and his interrogation is essential to recover the victim lady and the minor son. In the facts and circumstances as stated above, considering that the petitioner is named in the FIR and his photo was found in the house and as such I am not inclined to grant privilege of pre-arrest bail to the petitioner and accordingly his such prayer stands rejected in connection with the aforementioned case pending in the court of Shri S. Das, the learned Judicial Magistrate, Saharsa.
