The petitioner seeks bail in a case registered under Sections 302, 201/34 of the Indian Penal Code. Allegation is that the informant's son has love affairs with daughter of co-accused Moharram Mian. In that context, the accused persons called the informant's son from his house and killed the informant's son by slitting his neck. It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The name of the petitioner has transpired in this case merely on the basis of suspicion. Except for

Patna High Court CR. MISC. No.18301 of 2019(4) dt.02-08-2019 2/2 suspicion, there is no other substantive evidence to suggest his implication in the present case. There is no eye witness to the alleged occurrence.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil (Dhanauti O.P.) P.S. case No.575 of 2018.
