JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner seeks bail in a case instituted under Sections 147, 148, 149, 307 and 302/34 of the Indian Penal Code. The prosecution case, in brief, is that the petitioner and co-accused Anjani Singh are alleged to have repeatedly assaulted on the head of the deceased, as a result of which, he fell on the ground. Thereafter the deceased was taken to hospital by his father but the doctor declared him to be dead.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.03.2016. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of

Patna High Court Cr.Misc. No.34032 of 2016 (3) dt.28-09-2016 2/2 witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is admitted enmity between the parties. General and omnibus allegation has been made against the petitioner. The other co-accused have been granted bail vide Annexures-2 and 3 to the present application. On behalf of the state and learned counsel for the informant, it has been submitted that the petitioner is named in the F.I.R. Specific allegation of assault upon the deceased is alleged against the petitioner and co-accused Anjani Singh, causing injury on the head of the deceased. The postmortem report also corroborates the allegations made in the First Information Report. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in Khodawandpur P.S. Case No. 23 of 2016, pending in the court of learned Sub Divisional Judicial Magistrate, Manjhaul, Begusarai. Anyhow, the court below is directed to take all necessary steps to expedite the trial.
