JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-04-2015 Heard learned counsel for the petitioner and the learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is a lady and seeks anticipatory bail in a case registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

Learned counsel for the petitioner, referring to the First Information Report, submits that the only allegation against the petitioner is that she had called the victim girl and whereafter, she was kidnapped by co-accused Umesh Paswan. Learned counsel for the petitioner has submitted with reference to the statement of the victim girl Radhika Kumari recorded under Section 164 Cr.P.C that the petitioner had no role to play in the occurrence. In the facts and circumstances of the case, let petitioner above name, in the event of her arrest/surrender within four weeks

Patna High Court Cr.Misc. No.42335 of 2014 (2) dt.16-04-2015 from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in Bathnaha P.S. case No. 152 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
