Petitioner seeks bail in a case registered under sections 302, 328/34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased and according to the prosecution case itself, marriage of the deceased had taken place l1 years ago. However, relation of the deceased with the petitioner was not cordial and Mahua P.S. Case no. 370/2013 had been lodged against the petitioner by the brother of the deceased but even then she was residing with the petitioner. The informant claims that when he took the deceased to PMCH, Patna, deceased disclosed to him that it was Sindhu Kumari who administered poison to her and so far as the petitioner is concerned, he was standing there but he did nothing.
Investigation against the petitioner has already been
Patna High Court Cr.Misc. No.29860 of 2016 (4) dt.03-10-2016 completed and post mortem report of the deceased goes to show that no apparent injury was found on her person.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Mahua P.S.
